Insurance company suing LLHOA, who should be held accountable? Barone and the HOA board!

Insurance policy renewal was the collective action & responsibility of the Board - Barone, DiNapoli, Siegel and Umann.

Atain, the LLHOA's insurance company defending the LLHOA in the GPL lawsuit, is suing LLHOA in federal court to be released from the obligation to defend us. If request granted, LLHOA would have to pay for going forward with the GPL lawsuit.


Some members have said that Hal is the one to blame, because he is the one who signed the insurance policy contract, and his name is list in the lawsuit. Let's examine the facts.


The insurance company named Hal in the court filing, not because he was personally responsible for the insurance policy application, but because he signed it on behalf of the board and the LLHOA. Whomever signed it would have been named. At that time, Barone was still the president of the board and ruled with an iron fist. He did not allow anything to happen without his approval or direction. The board approved the renewal of the existing policy, the broker completed most of the application, and Barone told Hal, the LLHOA treasurer, to sign it.


Barone has an established pattern of not signing documents.

Our bylaws required that it be signed by the secretary or president. So why didn’t Barone sign the application? You will have to ask him. But his not signing legal documents is a well established pattern- Barone did not sign the summer camp contract with the swim club and the tennis club; did not sign the HOA office construction agreement; did not sign the golf course manager agreement; the list goes on. Is it that Barone would rather make someone else accountable for the board’s actions? Barone has gone so far as to circulate stories of bribes being involved. Just another baseless accusation by Barone against a LLHOA member with the integrity and fortitude to stand up to him. Could this be why he hasn't won a single lawsuit Umann or he has brought against LLHOA members? (lawsuits & results are listed here)


Barone and Umann, Bullying and Lies

You might have heard Barone and Umann's bullying rants about how the candidates, and their backers, running against Barone's three puppets on the LLHOA board are GPL supporters. Just as there is no truth to the GPL story, there is no truth to the bribe story. They appear to be the delusions of a demented mind.


You can choose to believe that Hal did it, or you can choose to be fair and put the blame on Barone and the board where it belongs. It was the collective action & responsibility of Barone, DiNapoli, Siegel and Umann. The choice is yours.
